Terms of Use

These Terms of Use (“Terms”) govern your use of the Misma app, provided by Overstruck UG (haftungsbeschränkt) (“we”, “us”, or “our”). By downloading or using Misma, you agree to these Terms. If you do not agree, please do not use the app.

Your license to install and use the Misma app is governed by Apple’s Licensed Application End User License Agreement, which you can read at apple.com/legal/internet-services/itunes/dev/stdeula.

These Terms govern your use of the Misma service — your account, Misma Plus, the referral program, and the disclaimers set out below. Where the two conflict in relation to the app license itself, Apple’s agreement controls.

Misma is intended for users aged 18 and older. By using the app, you confirm that you are at least 18 years old.

Misma is a personal savings and money-habit app. It helps you track your savings, set goals, learn general concepts about saving and investing, and stay motivated through playful features such as the garden and games. We may add, change, or remove features over time.

You need an account to use Misma. You are responsible for keeping your login credentials secure and for activity that occurs under your account. Please let us know promptly if you suspect any unauthorized use.

Misma offers an optional subscription, Misma Plus. Purchases and subscriptions are billed through your Apple App Store account. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period; you can manage or cancel them in your App Store account settings. Prices and features may change, and where required we will inform you in advance. Except where required by law or by Apple’s policies, payments are non-refundable.

Where we offer a referral program, rewards are subject to the program’s conditions and are intended for genuine referrals of new users. We may withhold or revoke rewards, and limit or end the program, if we detect abuse or manipulation.

You agree to use Misma lawfully and not to: misuse or disrupt the service; attempt to gain unauthorized access to it; reverse engineer, decompile, or copy the app except as permitted by law; or use the app to deceive others or circumvent our safeguards (including referral limits).

Misma is an educational and organizational tool. It does not provide financial, investment, tax, legal, or other professional advice, and nothing in the app is a recommendation to buy, sell, or hold any security or to adopt any investment strategy.

Any educational content is general in nature and does not take your personal circumstances into account. You should seek advice from a suitably qualified professional before making financial decisions.

Investing involves risk, including the possible loss of the money you invest. The value of investments can go up as well as down, sometimes significantly, and past performance is not a reliable indicator of future results.

Markets can be volatile and are affected by factors outside anyone’s control. You are solely responsible for your own financial decisions and their outcomes. Any figures, projections, or illustrations shown in the app are hypothetical, provided for illustration only, and are not a promise or guarantee of future returns.

Misma helps you record and visualize your finances, but you are responsible for the accuracy of the information you enter and for keeping your own records. Misma does not hold, manage, or move your money.

The app and its content, design, and trademarks are owned by us or our licensors and are protected by law. These Terms grant you a limited, personal, non-transferable, and non-exclusive license to use the app for your own personal use.

Third-party software included in the app is licensed under its own terms — see “Third-Party Software” in the app’s About section.

Misma relies on third-party services such as Apple, RevenueCat, and Supabase. Your use of those services may also be subject to their own terms and policies, and we are not responsible for third-party services.

To the fullest extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the app will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost profits or lost data, arising from your use of the app. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for intent or gross negligence or under mandatory statutory provisions.

We may update these Terms from time to time. If we make changes, we will update the effective date shown above. Your continued use of Misma after the changes take effect means that you accept the updated Terms.

You may stop using Misma at any time and delete your account in the app. We may suspend or end your access if you breach these Terms or misuse the service.

These Terms are governed by the laws of Germany, excluding its conflict-of-law rules, and without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
